Title insurance in DR: when it's worth buying

DR doesn't require title insurance. When you should buy it anyway, what it actually covers, and the specific properties where skipping it is risky.

Optional but sometimes mandatory in practice

Title insurance is not required to close on DR property. About 60% of foreign buyers skip it. The 40% who buy it typically purchase it because the property's title history has specific characteristics that make insurance prudent. Here's the framework.

What title insurance covers

A DR title insurance policy protects you against:

  • Defects in the title chain discovered after purchase
  • Liens or encumbrances not disclosed at closing
  • Claims by previous owners or heirs that weren't extinguished
  • Forged documents in the title history
  • Survey errors that affect property boundaries
  • Mortgage cancellations that weren't properly filed

If a covered claim arises, the insurer pays your legal defense costs and any settlement up to the policy limit.

Cost

DR title insurance is a one-time premium:

  • Roughly 0.4-0.6% of the property's purchase price
  • Paid at closing
  • Coverage typically lasts as long as you own the property (some policies extend to heirs)

On a $300K property: $1,200-$1,800 one-time. Compare to U.S. title insurance which is typically 0.5-1% AND requires re-issue on each subsequent transfer.

When title insurance is genuinely valuable

1. Older properties with multi-decade title chains

If the property has had 4+ owners over 20+ years, the chance of an unresolved issue in the chain is higher. Title insurance is cheap insurance.

2. Properties without recent deslinde

Land that completed deslinde more than 10 years ago, or whose deslinde process had any irregularities. Higher risk of subsequent challenges.

3. Properties acquired through inheritance

Inherited properties sometimes have heir disputes that only surface years later when a sibling or distant relative discovers the inheritance. Insurance protects against this.

4. Properties in Samaná or rural areas

Where deslinde history is more variable and possessory claims (posesión) by farmers and local families can surface after closing.

5. Pre-construction conversions to title

When the developer converts the building's master title into individual unit titles, the process can have hiccups. Insurance covers gaps.

6. Buying from a foreign seller via Power of Attorney

The chain involves a foreign-issued document. If any step in that document chain is later challenged, you're protected.

When you can probably skip it

1. Brand new construction from a vetted developer

The title is freshly issued, the chain is short, and the developer is contractually responsible for clean delivery.

2. Resale of recently constructed property (under 5 years)

Same logic as above: short chain, low risk.

3. Properties in modern gated communities (Cap Cana, Casa de Campo, Cocotal)

These have institutional-grade title processes. Issues are rare.

4. When your DR attorney issues a clean title opinion

A real attorney's title certification with their professional liability behind it is functionally equivalent to insurance for many issues.

For every foreign buyer we work with, we run a title risk analysis. Recommendations follow this pattern:

  • New construction from vetted developer: skip
  • Resale 5-15 years old, clear chain: skip
  • Resale 15+ years old: consider buying
  • Inherited property purchase: strongly recommend buying
  • Land purchase: strongly recommend buying
  • Samaná or rural property: strongly recommend buying

How to buy

DR title insurance is available from:

  • First American Title (international division)
  • Stewart Title (international division)
  • Local DR insurers (Mapfre BHD, La Colonial offer limited products)

Premium varies slightly between providers. Local issuance through your DR attorney is typical; international policies require more paperwork but are more comprehensive.

What we tell clients

Title insurance is the most over-skipped protection in DR. The premium is small. The protection is meaningful for the specific properties where issues are most likely. If you're buying anything over 15 years old, the cost-benefit math almost always favors buying.
